Terms of Service — Outperform

1. Service Description

Outperform provides AI-powered competitive pricing and positioning analysis for software companies. The service analyzes publicly available pricing information from company websites and generates comparative reports, buyer assessments, and strategic recommendations.

2. Acceptable Use

You agree to use Outperform only for legitimate business intelligence purposes. You may not use the service to: (a) scrape or redistribute competitor data at scale; (b) misrepresent AI-generated analysis as human-authored research; (c) attempt to reverse-engineer, abuse, or overload the service; (d) use the chat feature for purposes unrelated to competitive pricing analysis.

3. Credits & Payments

Outperform operates on a credit-based system. Credits are consumed when running analyses and using the strategy chat. New accounts receive 2 complimentary credits. Additional credits can be purchased via Stripe. All purchases are final and non-refundable. Credits do not expire.

4. AI-Generated Content

All analysis results, recommendations, and chat responses are generated by artificial intelligence (Claude by Anthropic). While we strive for accuracy, AI outputs may contain errors, omissions, or outdated information. Outperform does not guarantee the accuracy, completeness, or reliability of any AI-generated content. You should independently verify any information before making business decisions.

5. Data & Privacy

Outperform only analyzes publicly available information from company websites. Your analysis data is stored securely and is not shared with third parties. See our Privacy Policy for details on how we handle your personal information.

6. Limitation of Liability

Outperform is provided "as is" without warranties of any kind. We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the service, including but not limited to business decisions made based on AI-generated analysis. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

7. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time by contacting support. Upon deletion, your analysis data will be permanently removed within 30 days.

8. Changes

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.
